1. Agreement to These Terms
These Terms & Conditions govern your use of the Purdon Marketing Group website and any services you purchase from Purdon Marketing Group (“PMG,” “we,” “us,” or “our”). By using our website, submitting a form, booking a call, accepting a proposal, or purchasing services, you agree to these terms.
2. Services
PMG provides marketing, website, automation, and related business-growth services. Our Website Growth Plan includes a one-time website setup service and ongoing website hosting, maintenance, and support, subject to the scope confirmed with you. Additional services, including advertising management, may require a separate proposal or agreement.
3. Fees and Billing
The Website Growth Plan is $500 for initial setup and $99 per month for ongoing service, unless your written proposal states otherwise. Setup fees are due before work begins. Monthly service fees are billed in advance and renew automatically each month until canceled under these terms. Applicable taxes may be added where required.
4. Payment Authorization
You authorize PMG and its payment processor, including Stripe, to charge the payment method you provide for agreed setup fees, recurring fees, approved add-ons, and applicable taxes. If a payment is declined or overdue, we may pause services until the account is brought current.
5. Client Responsibilities
You are responsible for providing accurate business information, timely approvals, access to required accounts, and any content, images, logos, licenses, permissions, or claims used on your website or in your marketing. You represent that you have the right to use all materials you provide to PMG.
6. Website Content and Revisions
PMG will build and maintain the website based on the agreed scope. Reasonable maintenance and revisions may be included in the ongoing plan; substantial changes, new pages, custom functionality, content creation, or work outside the agreed scope may be quoted separately. Delays in receiving required materials or approvals may delay delivery.
7. Ownership and Access
You retain ownership of content and materials you provide. PMG retains ownership of its pre-existing tools, templates, systems, processes, and reusable materials. Your website remains active while your account is current. Upon cancellation, transfer, export, or continued use of any work may be subject to the terms of your proposal and payment of all outstanding amounts.
8. Cancellation
You may cancel ongoing monthly service by giving at least 30 days’ written notice to [email protected]. Fees already paid are non-refundable except where required by law or expressly agreed in writing. PMG may suspend or terminate services for nonpayment, unlawful use, abuse, or a material breach of these terms.
9. No Guarantee of Results
Marketing results depend on many factors outside PMG’s control, including your market, offer, pricing, reputation, sales process, competition, advertising budget, and client participation. PMG does not guarantee rankings, leads, sales, revenue, or any specific business result.
10. Third-Party Services
Your services may rely on third-party providers such as GoHighLevel, Stripe, domain registrars, email platforms, advertising platforms, and hosting providers. Their services are governed by their own terms and policies. PMG is not responsible for third-party outages, policy changes, account restrictions, or fees.
11. Limitation of Liability
To the fullest extent permitted by law, PMG will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or business interruption. PMG’s total liability related to services will not exceed the amounts you paid to PMG for the affected services during the three months before the event giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold PMG harmless from claims, losses, liabilities, and expenses arising from content or materials you provide, your products or services, your misuse of our services, or your breach of these terms.
13. Changes to These Terms
PMG may update these Terms & Conditions from time to time. The revised version will be posted with a new effective date. Continued use of the website or services after an update constitutes acceptance of the revised terms.
14. Governing Law and Contact
